These Terms of Service ("Terms") govern your access to and use of the TheDietPal website located at thedietpal.com ("Website") and your engagement with the at-home wellness services provided by TheDietPal ("we", "us", "our"), a wellness services business registered and operating in Mumbai, India.

By visiting our Website, submitting an enquiry, booking a service, or communicating with us via WhatsApp, phone or email, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must not use our Website or engage our services. We reserve the right to refuse service to anyone who violates these Terms.

2. Our Services

TheDietPal provides at-home wellness and body sculpting services, delivered by certified therapists to clients' homes across Mumbai and selected locations. Our current service offerings include:

• U-Lipolysis — Non-surgical fat reduction using ultrasonic energy
• RF Skin Tightening — Radiofrequency-based collagen stimulation and skin firming
• Electro Muscle Stimulation (EMS) — Electrical muscle toning therapy
• Tummy Tuck — Non-surgical abdomen flattening and sculpting
• Inch Loss Program — Personalised multi-treatment inch loss with diet planning
• Laser Hair Reduction — Diode laser-based long-term hair reduction

We also provide blood-group based personalised diet plans and lifestyle guidance as part of our wellness programmes.

We reserve the right to modify, suspend, discontinue or add services at any time without prior notice. We will endeavour to inform existing clients of material changes to services they are currently receiving.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age. Clients under 18 may only receive services with the written consent of a parent or legal guardian, who must be present during all sessions
• Be located in a geographic area covered by our service network (currently Mumbai and select surrounding areas)
• Provide accurate and complete information about yourself, including any relevant medical conditions, when booking
• Not be pregnant unless explicitly cleared by your physician and disclosed to us prior to booking
• Not have any medical condition that contraindicates the booked treatment (we will screen for contraindications during consultation)

We reserve the right to decline or discontinue services at our sole discretion if we determine that a service is not appropriate or safe for a particular client based on their health status or other relevant factors.

4. Bookings & Appointments

4.1 Booking Process

Appointments may be booked via WhatsApp, telephone, email, or through enquiry forms on our Website. A booking is confirmed only when you receive a written confirmation from us (typically via WhatsApp or email).

4.2 Client Responsibilities

When booking and receiving our services, you agree to:

• Provide a safe, accessible and reasonably clean environment for our therapist to work in your home
• Disclose all relevant medical conditions, medications, recent surgeries or other health information that may affect treatment safety
• Be available at the confirmed appointment time — or notify us at least 24 hours in advance if you need to reschedule
• Ensure appropriate clothing is worn or available for the treatment area
• Follow all pre-treatment and post-treatment instructions provided by our therapist
• Not be under the influence of alcohol or drugs during any session

4.3 Our Right to Cancel

We reserve the right to cancel or reschedule an appointment if our therapist is unavailable due to illness, emergency or circumstances beyond our control. In such cases, we will notify you as soon as possible and offer an alternative appointment at no additional cost.

4.4 Late Arrivals

If our therapist arrives at the scheduled time and you are not available, or if access to your home is not possible without prior notice, the session may be treated as a no-show (see Section 5 — Cancellation Policy).

5. Cancellation & Rescheduling

We understand that circumstances change. Please contact us as soon as you know you need to reschedule — we will always try to accommodate genuine emergencies.

5.1 Programme Packages

If you have purchased a session package or programme, unused sessions remain valid for 6 months from the date of purchase. Extensions may be granted at our discretion in cases of illness or other extenuating circumstances.

5.2 Refunds

Refunds are assessed on a case-by-case basis. Where sessions have been prepaid and a programme is discontinued at the client's request, we will evaluate the circumstances and may offer a pro-rata refund or credit. Please contact us directly to discuss your situation.

6. Payment & Pricing

6.1 Pricing

Prices for our services are provided during consultation and are confirmed before any session commences. Pricing may vary based on the treatment, number of sessions, and any current promotions. All prices are quoted in Indian Rupees (₹) and are inclusive of applicable taxes unless otherwise stated.

6.2 Payment Methods

We accept the following payment methods:

• Cash (paid at the time of session)
• UPI (Google Pay, PhonePe, Paytm and other UPI apps)
• Bank transfer (NEFT/IMPS)
• Other methods as agreed upon at the time of booking

We do not store or process credit or debit card information. All digital payments are made directly through third-party payment applications.

6.3 Pricing Changes

TheDietPal reserves the right to change prices at any time. Price changes will not affect sessions or packages already confirmed and paid for. New pricing will apply to new bookings made after the price change date.

6.4 Promotions and Offers

Special offers, discounts and package prices are subject to availability and may be withdrawn at any time. Promotional offers cannot be combined with other discounts unless explicitly stated.

7. Health & Medical Disclaimer

7.1 Not Medical Treatment

TheDietPal provides wellness and aesthetic services only. Our treatments are not medical procedures and are not regulated as such. We are not a medical establishment, clinic, hospital or healthcare provider. Our therapists are wellness and aesthetic professionals, not medical doctors.

7.2 No Medical Advice

Nothing on our Website, in our communications, or in our service sessions constitutes medical advice, diagnosis or treatment. Diet plans provided are for general wellness purposes only. If you have a medical condition, are pregnant, or are taking medication, you must consult a qualified medical professional before booking any of our services.

7.3 Results Disclaimer

Results from our treatments vary significantly between individuals. Factors including body type, lifestyle, diet, age, and compliance with our recommendations all affect outcomes. Any results described on our Website, in testimonials or in marketing materials represent typical experiences and are not guarantees of specific outcomes for any individual client.

7.4 Contraindications

Our services may not be suitable for individuals who:

• Are pregnant or breastfeeding
• Have a pacemaker or other electronic implant
• Have active cancer or are undergoing cancer treatment
• Have uncontrolled diabetes, heart conditions or blood disorders
• Have metal implants in the treatment area
• Have active skin infections, open wounds or inflammatory skin conditions in the treatment area
• Have a history of photosensitivity (for laser treatments)

It is your responsibility to disclose all relevant medical information before and during your programme. TheDietPal will not be liable for any adverse events arising from undisclosed medical conditions.

7.5 Client Consent

By booking and receiving our services, you confirm that you have disclosed all relevant medical information, understood the nature of the treatment, and consented to receive the service. You release TheDietPal and its therapists from liability for any adverse reactions caused by undisclosed contraindications.

8. Client Conduct

We are committed to providing a professional, respectful and safe environment for our therapists. In return, we expect all clients to treat our staff with courtesy and respect.

The following conduct is strictly prohibited and may result in immediate termination of services without refund:

• Harassment, abuse or threatening behaviour towards any TheDietPal therapist or staff member
• Sexual harassment or inappropriate physical contact directed at our therapists
• Providing false or misleading information about your health or identity
• Attempting to use our services for purposes other than those intended
• Recording sessions without the explicit prior consent of the therapist
• Being under the influence of alcohol or illegal substances during sessions

TheDietPal reserves the right to refuse or discontinue services to any client without prior notice in cases of misconduct.

9. Intellectual Property

All content on the TheDietPal Website — including but not limited to text, images, graphics, logos, icons, photographs, treatment protocols, diet plans, videos and the overall "look and feel" of the Website — is the intellectual property of TheDietPal and is protected by applicable Indian and international copyright, trademark and intellectual property laws.

You may not, without our prior written permission:

• Copy, reproduce, republish or distribute any content from our Website
• Use our brand name, logo or trademarks in any way
• Create derivative works based on our content

Submitting a franchise enquiry on our Website does not create any contractual obligation on either party.

All information shared during the franchise enquiry process is treated as confidential on both sides, subject to our Privacy Policy. Any proprietary business information shared by TheDietPal during the franchise discovery process remains the property of TheDietPal and may not be disclosed or used by the enquiring party for any purpose other than evaluating the franchise opportunity.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising from these Terms or our services.
